Sexual Harassment

 

Q.:      I take care of an old lady and work as a live-in in her house. Her son visits her very often. He offends, makes dirty jokes, talks about sex. I heard that there is a law in America that punishes sexual harrassers but I dont know how to understand what sexual harassment is and where to file a complaint. What are my rights? 

 

A.:     According to the EEOC (Equal Employment Opportunity Commission), sexual harassment can take several forms.  In simple terms it is unwelcome verbal or physical conduct of a sexual nature.  If somebody repeatedly makes sexual comments to or about you, it can be sexual harassment.  Obviously touching or grabbing you in a sexual way qualifies.  But there are many more subtle forms.  If there are people in your workplace for example, who like to loudly tell dirty jokes or stories in front of everybody they might be guilty.  Someone who displays sexually oriented pictures or other items might also.  The key is that you have made it clear that you are not comfortable with the behavior, and it has continued anyway.

Seksualinis priekabiavimas

A.: Pasak EEOC (Equal Employment Opportunity Commission- vienod galimybi darbuotojams komisijos), seksualinis priekabiavimas gali pasireikti keliomis formomis. Paprastai kalbant, tai nepageidautinas odinis ar fizinis seksualinio pobdio elgesys. Jeigu kas nors pakartotinai laido seksualinius komentarus apie jus, tai gali bti  seksualinis priekabiavimas. Jam priskirtinas ir js kno lietimas bei grabinjimas su tam tikra seksualia potekste.  Taiau manomos ir kitokios subtilesns formos. Jeigu js darbo vietoje yra moni, kurie mgsta garsiai pasakoti purvinus juokelius arba istorijas kitiems girdint, jie taip pat gali bti apkaltinti seksualiniu priekabiavimu; lygiai kaip ir tie, kurie rodo seksualins pakraipos paveikslus, nuotraukas. Esm tame, kad  aikiai btumte praneusi, jog nesijauiate patogiai tokio elgesio akivaizdoje ir tas elgesys vis tiek nesikeiia.

Seksualinis priekabiavimas gali pasireikti vairiausiais bdais, skaitant emiau ivardintus:

  • Auka lygiai kaip priekabiautojas gali bti tiek vyras, tiek moteris. Auka nebtinai turi bti prieingos lyties.

  • Priekabiautojas gali bti aukos priirtojas (supervaizeris), darbintojo agentas, kito darbo baro supervaizeris, bendradarbis, - arba ne dirbantysis.

  • Aukomis nebtinai turi bti asmenys, prie kuri priekabiaujama, bet tie, kurie yra   veikiami eidianio elgesio (veiksmas vyksta alia, matomas).

  • statymais draudiamas seksualinis priekabiavimas nebtinai turi bti siejamas su aukos patirtais ekonominiais ar darbins veiklos nuostoliais (auka nebtinai patyr pinigini nuostoli, nebtinai buvo atleista dl to i darbo ir pan.).

  • Seksualinis priekabiavimas negali bti toleruojamas.

Federalin teis prie seksualin priekabiavim taikoma visiems darbdaviams, turintiems 15 ar daugiau darbint moni, skaitant valstijos ar vietos vyriausybs padalinius.   • The victim as well as the harasser may be a woman or a man. The victim does not have to be of the opposite sex.

  • The harasser can be the victim's supervisor, an agent of the employer, a supervisor in another area, a co-worker, or a non-employee.

  • The victim does not have to be the person harassed but could be anyone affected by the offensive conduct.

  • Unlawful sexual harassment may occur without economic injury to or discharge of the victim.

  • The harasser's conduct must be unwelcome.

Federal laws against sexual harassment apply to all employers with 15 or more employees, including branches of state and local government.  If you would like more information about filing a sexual harassment complaint with the EEOC, take a look at the following website:

In addition most states have laws against sexual harassment.  For instance, the law in Illinois is similar to the federal law, but does not include the 15-employee minimum.  To get more information on filing a complaint under Illinois law against sexual harassment, go to the following website:

You can also call the Illinois Department of Human rights at (312) 814-6200 in Chicago or (217) 785-5100 in Springfield.  In other states, contact your state Department of Labor.  They will be able to direct you to the appropriate office.

 

If you are thinking of filing a charge of sexual harassment there are a couple of things to keep in mind.  The more documentation you have the better.  Keep a record of offensive behavior, including dates and times.  Also record the times you have complained about the behavior, including whom you spoke to, what you said to them and how they responded.  Also keep in mind that complaints usually need to be files within 180 days of the problem.  You cannot file a complaint about things that happened years ago.

 

If you work in a private home as a housekeeper or caregiver, unfortunately you have a little less protection, especially about unwanted comments.  But there is still a very clear line that cannot be crossed.  If anybody touches you in an unwanted sexual way, or tries to force you to have sex to get or keep a job, that is more than sexual harassment.  It is sexual assault.  In most states that is a felony and the person who does it can go to jail.  If you find yourself in such a situation, stand up for yourself.  Even if you are illegal, dont believe that they can have you deported.  They cant.  They are in far more trouble than you are and they know it.  Go to your local police station and file a police report.  And do it immediately.  The longer you wait the weaker your case will be.  If you need to go to court and testify, do it.  If this person did this to you, it was probably not the first time and will probably not be the last.  People who commit sexual crimes usually repeat them until they are stopped.  If you just sneak out the back door and hope for the best, the chances are very good that somebody else will be victimized by this person very soon.
