On the Job Injury

 

Q: Rita works in a factory in Massachusetts.  She has a green card and came here one year ago.  This is her first job.  She works 12 hour shifts and thinks her health has been damaged by the physical and psychological conditions of her work.  She asked to be moved to an easier job, but was refused.  She thinks she is being exploited.  She doesn't believe that in the 21st century slavery should be allowed to exist.

 

A: First let's be clear about one thing.  You may not like your job but you are not a slave.  You are perfectly free to quit and find another job at any time.  Slaves can't do that.

K:  Ikilo problem darbe dl pablogjusios sveikatos. Jau kelet kart teko palikti darbo viet dl prastos savijautos. Darbas tikrai sunkus (fizinis), fabrike, dirbu naktimis, pamainos po 12 val. pamaina. Esu 21- eri, Amerik atvykau ilousi alia kort madaug prie metus. teism noriau kreiptis dl pablogjusios sveikatos darbo metu, dl moni inaudojimo. Darbe nemonikos slygos, trksta moni, tempas didelis, kartais tenka atlikti ir vyrikus darbus, nuolatinis psichologinis spaudimas. Papasakojus savo simptomus gydytojai, buvo liepta nieko nelaukiant vaiuoti "emergency room", visk irima labai rimtai. Pradjau prayti vadov, kad perkelt kit viet, taiau jiems tai nusispjaut. Tikiuosi, kad kiti taip ilgai nesiaukos ir netaps ,,vergais" XXI- ajame amiuje. Kiekvienas mogus turi tam tikras pareigas, taiau nereikia pamirti ir apie teises!

A: Pirmiausia isiaikinkime vien dalyk. Tu gali nemgti savo darbo, bet nesi verg.Jo atsisakius, susirasi kit, o vergai to negali. 

Jeigu tikrai galvoji bylintis, reiks susirasti advokat. Mes negalime imtis ios atsakomybs ir duoti teisini patarim. Taiau mes galime pateikti kelet nuomoni apie Tavo situacij. Tu tiksliai nenurodei kokio pobdio al darbas padar Tavo sveikatai. Yra daugyb darb, kurie kai kuriems monms tiesiog per sunks, per daug reikalaujantys.  Jeigu  i 120 svar sverianios moters darbe reikalaujama kilnoti po 100 svar sverianius cemento maius, tai toks darbas gali pakenkti sveikatai ir tai nebtinai bus jos darbdavio kalt. Tikims, kad joks darbdavys nepriims tokiam darbui tokio asmens, bet net jei ir priimt, tai tik Tu galtum nusprsti, kad nesi tam tinkama ir kad turi pasiiekoti kitokio darbo. JAV galioja daugyb taisykli, lieiani darbuotoj sveikat ir saugum, ypa pramons gamyklose (industrial plants).  Tas taisykles administruoja federalin agentra, vadinama OSHA (Occupational Safety and Health Administration).  OSHA inspektoriai periodikai lankosi visose gamyklose, tikrindami ar nra paeidiamos nustatytos taisykls. Aptik tam tikr problem jie gali versti darbdav jas paalinti, arba sumokti baud.  Ypatingais atvejais darbdavys gali net atsidurti kaljime. OSHA praneimai (reports) yra visuomenei prieinami

On the Job Injury

 

Q: Rita works in a factory in Massachusetts.  She has a green card and came here one year ago.  This is her first job.  She works 12 hour shifts and thinks her health has been damaged by the physical and psychological conditions of her work.  She asked to be moved to an easier job, but was refused.  She thinks she is being exploited.  She doesn't believe that in the 21st century slavery should be allowed to exist.  She wants to know if she can sue her employer.

 

A: First let's be clear about one thing.  You may not like your job but you are not a slave.  You are perfectly free to quit and find another job at any time.  Slaves can't do that.

 

If you really think you want to sue, you will need to find a lawyer.  We cannot give you legal advice.  But we can give you some opinions about your situation.  You were not very specific about what kind of damage you think your job has done to your health.  There are many jobs that are simply too demanding for some people.  If you are a 120 pound woman and your job requires you to lift 100 pound bags of cement, that job will damage your health, but it will not necessarily be your employers fault.  Hopefully, no employer would hire such a person to do that job, but if one did, it would be up to you to recognize that you were poorly suited to do it and find another.  You could not demand that the employer buy cement in smaller bags.  Likewise you cannot demand that your employer move you to an easier job.  You can ask, there is no harm in that.  But he can refuse and you will need to decide whether you want to remain in the same job or quit.

 

In the US there are many rules regarding the safety and health of workers, especially in industrial plants.  These rules are administered by an agency of the Federal government called OSHA (Occupational Safety and Health Administration).  OSHA inspectors periodically visit all factories to look for violations of their rules.  If they find any problems, the employer can be forced to correct the situation, and maybe pay a fine.  In extreme cases he can even go to jail.  OSHA reports are public records.  You can contact them and get a copy of their most recent inspections of your workplace.  If you suspect that your health problems were caused by things your employer did that violate OSHA rules, you might be able to sue.  If you do, look for a lawyer who is willing to take your case on a "contingency" basis.  That means that you pay him if and only if you win your case.  The lawyer will then take a percentage of the settlement as his fee.  As you can imagine, most lawyers will only  take contingency cases when they expect to win.  If they think your case is weak, they won't take it on that basis.
