By now everybody in the immigrant community has heard about the raids on 42 IFCO plants around the country where 1,187 illegal workers were arrested.  Compare this number to the 150 who were arrested all of last year.  Obviously this marks a dramatic change in policy regarding enforcement of immigration laws, but what is the new policy?  Do these raids signal the start of a roundup of all undocumented workers?

By now everybody in the immigrant community has heard about the raids on 42 IFCO plants around the country where 1,187 illegal workers were arrested.  Compare this number to the 150 who were arrested all of last year.  Obviously this marks a dramatic change in policy regarding enforcement of immigration laws, but what is the new policy?  Do these raids signal the start of a roundup of all undocumented workers?

 

At least for now it doesnt look like it.  Although more than a thousand workers were arrested, and most of them will probably be deported, this operation was not aimed at the workers, but at their employer.  IFCO, a palette manufacturer with about 3500 employees went out of their way to recruit illegal workers.  They paid to transport them from places near the Mexican border to plants around the country.  They gave them advice on how to buy fake documents, and how to avoid being noticed by the law.  Their actions made it very clear that using illegal workers was no accident.  It was a central part of their way of doing business.

 

They paid substandard wages.  Their employees received about $6.50 an hour, compared to $9.00 to $14.00 for their competitors who hired legal workers.  They did not pay for overtime.  They made the workers do their jobs in dirty, dangerous conditions.  Pete Smith, the agent who led the raid on the Albany NY plant was quoted as saying No legal facility would let workers work in those conditions.

 

The director of the Homeland Security Department made it very clear what the intent was.  He said the effort is aimed at those who are "exploiting illegal aliens" and "who adopt as a business model the systematic violation of immigration laws." The federal government will "make sure we come down as hard as possible."

 

If these raids are the opening shots of a war, it is a war on employers, not workers.  But like in any war, others will be caught up in it.  Workers will be arrested and deported.  But although it will not seem like it to those who get caught, this will be a side issue.

 

This case is a very good example of the problem America faces in trying to decide what to do with illegal immigrants.  There are many companies like IFCO, who knowingly hire illegals because they are cheaper.  They spend less on salaries.  They spend less on maintaining a safe workplace.  They spend less in a lot of different ways.  This allows them to sell their products for prices their legal competitors cannot match.  The competitors are forced to reduce salaries and benefits to their workers.  They are forced to cut corners on safety and quality so that they can sell their product at similar prices.  With lower salaries and benefits, the formerly legal companies find it harder and harder to hire legal workers, and they turn to the illegal labor market.  This becomes a creeping cancer that pushes some American workers out of jobs and lowers the standard of living of the rest.

 

If all the illegal workers in the country today were suddenly legalized, this problem would not go away.  After a while, newly legal workers would start demanding higher wages, proper overtime pay, safe workplaces, and other costly things.  Companies like IFCO would not suddenly start doing everything by the law.  They would instead encourage new illegals to come into the country and be exploited like the old ones had been.  In the long run nothing would be different.

 

There is an almost unlimited supply of people in Mexico and Central America who would come to America and work illegally if given the chance.  Just getting to the US border is an incredibly difficult and dangerous journey.  Many are killed or maimed.  Many others are robbed, raped or beaten.  Getting across the border is almost the smallest part of their trip.  Prospects in their home countries are so poor that it makes very good economic sense for them to take the enormous risks to get to America, no matter what punishment the American government might give them if they are caught.  The only way to significantly slow the rate of illegal immigration is to get rid of the prize that is luring them here jobs.  Workers may not care very much what punishments they will receive if caught, but their employers do.  They do not hire illegals because it is the only way to feed their families.  They do it because they are greedy or lazy or because they like feeling like kings when their workers are too fearful to talk back to them.

 

It may be difficult for illegal workers to understand, but the immigration debate is not about what is best for them, it is about what is best for Americans.  Are Americans better off with the situation the way it is now?  Or would they be better off with some kind of a change, and if so, what?  There are some who like things just the way they are, but those are mostly the exploiters, the users.  Some say that the US should just kick them all out.  Send them back wherever they came from no matter if they have a home there or any way to live.  Most Americans have a touch of sympathy for this point of view, but Americans by and large are both practical and humane.  It simply isnt possible to track down and deport 11 or 12 million people, and it would also be a very cruel thing to do.  The only workable option is to try to find some way to bring many or most of these millions into the mainstream of American society.  But it is becoming increasingly obvious that to do that we have to get rid of illegal employers.

 

Illegal workers like to say that they do jobs that Americans wont do.  In a few limited areas like picking fruits and vegetables, this may be true, but mostly illegals just do the dirty jobs at a price Americans wont work for.  If somebody advertised a job scrubbing toilets for $15 an hour with health benefits, plenty of Americans would be willing to do that work.  But not for $5.50.

 

The goal for most Americans is to create a system where all workers are legal and paid a decent wage.  This will never completely happen of course, but any immigration reform that happens must be aimed at that target.
