Becoming Legal

Thank you for your answer in the last weeks issue. I came without a visa in 2003. Is it a crime? I married a USA citizen in 2004. We signed documents to buy real estate and nobody asked about immigration documents. We have a newborn child. We tried to legalize me but it isnt clear in which direction our destiny is moving. One time we hear this, another time this.  Will they push me to go Lithuania and leave my child without mother or will they allow me to do my documents?

It looks like my husband will need to leave his homeland for our familys sake and it looks like his countries law doesnt defend him. Maybe it would be better if they would ask about immigrant status before marriage- we didnt know it means so much.

I used my own passport everywhere, know English very well, talk only English at home because my husband doesnt know Lithuanian. Id like to study in an American college.

Labai sudtinga atsakyti Js klausim. The answer to your question is complicated.  The reason you have not been able to adjust your immigration status is because you came into the country illegally, unlike many Lithuanians who entered legally, but overstayed their visa.  You say you have been to a lawyer, but you still dont know what your possibilities are.  This is a sign that your lawyer might not be right for you.  You should consider finding a different one.  The Illinois State Bar Association has a lawyer referral service that you can find at:

Where it says, Select a field of practice choose Immigration and/or Naturalization and click GO.  A list of approved lawyers will be displayed.  Find one in your area that seems to meet your needs.  Give him a call and ask if he offers a first consultation, either free or for a small charge.  Most reputable lawyers will do this.  You can go in, discuss your problem for 15 to 30 minutes, and find out if he can help you.  It should not cost much more that $25 for this first visit.  Of course if you choose to hire this person to represent you, you will pay considerably more, but at that point you should have a pretty clear idea of what he can and cannot do for you.

 

There is another thing to keep in mind.  The US Congress is under quite a bit of pressure to produce some kind of immigration reform bill this year.  There is a lot of controversy about what form this will take, but there is a pretty good possibility that it will offer some chance for you to at least get a work permit, and maybe eventually a green card.  Nobody can make any promises about this now because nobody knows what the law will eventually say, but it might be a good idea to see what happens.  There is a bill sponsored by Senators McCain and Kennedy that would allow people who are currently illegal to pay a $2000 fine and any back taxes, and get a chance to work legally.  This bill would eventually allow these people to apply for green cards, if they learn English and stay out of trouble.  If this bill or something like it passes, it may give you the chance you need.  If you can get a work permit, and make your presence in the US legal, you should then be able to apply for a green card based on your marriage.

 

It is important to emphasize that this bill is not yet a law and might never become one.  We will know more in a few months.  Dont pay money to anybody who says he can get you on a list or do anything else now.  Wait and see what kind of law is passed and then decide what to do.
